This Terms of Service agreement (the "Agreement") outlines the terms and conditions by which you may access and use the services provided by MasterDEX Inc (hereinafter referred to as "MasterDEX Inc", "we", "us", or "our"). These services include, but are not necessarily limited to, (a) MasterDEX.xyz, a web-hosted user interface (the "Interface" or "Platform"), (b) an aggregation of various third-party DeFi offerings (the "DeFi Aggregator") and (c) our mobile application (the "MasterDEX App").

You must read this Agreement thoroughly as it governs your use of our services. By accessing or using any of our services, you signify that you have read, understood, and agreed to be bound by this Agreement in its entirety. If you disagree, you are not authorized to access or use any of our services and should refrain from doing so.

To access or use any of our services, you must be capable of forming a legally binding contract with us. Consequently, you represent that you are at least the age of majority in your jurisdiction and have the full right, power, and authority to enter into and comply with the terms and conditions of this Agreement on behalf of yourself and any company or legal entity for which you may access or use the Interface. If you are entering into this Agreement on behalf of an entity, you affirm to us that you have the legal authority to bind such entity.

Moreover, you represent that you are not (a) subject to economic or trade sanctions administered or enforced by any governmental authority or listed on any registry of prohibited or restricted parties or (b) a citizen, resident, or organized in a jurisdiction or territory that is the subject of comprehensive country-wide, territory-wide, or regional economic sanctions. Lastly, you represent that your access and use of any of our services will fully comply with all applicable laws and regulations, and that you will not access or use any of our services to conduct, promote, or otherwise facilitate any illegal activity.

NOTICE: This Agreement contains critical information, including a binding arbitration provision and a class action waiver, both of which impact your rights concerning how disputes are resolved. Our services are available to you — and you should only access any of our services — if you completely agree with these terms.

Acceptance of Terms: You agree to be bound by this Agreement by accessing, browsing or using the services on MasterDEX.xyz. If you do not agree with these terms, you should immediately cease all usage of MasterDEX.xyz.

User Eligibility: You confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. You agree to provide accurate and complete information about yourself as prompted by any registration forms on the Service.

Compliance with Laws: You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable taxes applicable to the use of the Service in your local jurisdiction.

Non-Investment Advice: The information provided on MasterDEX.xyz is for informational purposes only and should not be construed as investment advice. We are not responsible for any investment decisions or the results of any investment decisions that you make. We recommend consulting with a financial advisor or conducting your own research before making any investment decisions.

Use of MasterDEX.xyz: You agree that the Service is provided "as is" and "as available" . We disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement or bailment of your data on MasterDEX.xyz.

User Content: You are solely responsible for any content that you upload, publish or display on or through the Service or transmit to or share with other users. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.

Indemnification: You agree to indemnify, defend and hold harmless MasterDEX Inc, its parents, subsidiaries, affiliates, officers and employees, from any loss, liability, claim, or demand, including reasonable attorneys fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement.

Limitation of Liability: In no event shall MasterDEX Inc be liable for any indirect, incidental, special, consequential damages or punitive damages resulting from the use of or inability to use the Service, or any damage, loss or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account.

Dispute Resolution: Any disputes arising from this Agreement shall be resolved through arbitration in the British Virgin Islands. Both parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the British Virgin Islands.

Amendments: MasterDEX Inc reserves the right to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.

By using MasterDEX.xyz, you agree to these terms. If you do not agree, do not use MasterDEX.xyz.
